Terms and Conditions of the Online Store

This document sets out the rules of operation of the online store www.moretalks.shop. Here you will find in particular information on the rules of placing orders, the offer, the right of withdrawal, and liability for non-conformity of goods with the contract.

§1 Definitions

Store – the online store available at www.moretalks.shop.

Seller – sole proprietorship (JDG) run by Katarzyna Chilimoniuk, operating under the business name Co&Sisters Katarzyna Chilimoniuk, with its registered office at ul. Trakt Królewski 182A, 05-083 Zalesie, Poland, entered into the Central Register and Information on Economic Activity (CEIDG), NIP: 1182249331, REGON: 523310690, e-mail: hello@moretalks.shop, tel. +48 790 890 788.

Client – a natural person, legal person, or organizational unit without legal personality, which is granted legal capacity by law, placing an order within the Store and purchasing goods via the Store.

Consumer – a natural person concluding a contract with the Seller, where the subject matter is not directly related to their business or professional activity.

Entrepreneur with consumer rights – a natural person conducting a sole proprietorship, concluding a contract directly related to their business activity, where the contract indicates that it does not have a professional nature for them.

Account – the Client’s account created on the Store’s platform, enabling access to purchased services and goods.

Sales Agreement – an agreement for the sale of Goods concluded between the Seller and the Client via the Store.

Goods – a physical item, digital content or service, or digital service offered for sale in the Store.

Seller’s Data – the Seller’s contact details, in particular for complaints and returns: Co&Sisters Katarzyna Chilimoniuk, ul. Trakt Królewski 182A, 05-083 Zalesie, Poland, NIP: 1182249331, REGON: 523310690, e-mail: hello@moretalks.shop, tel. +48 790 890 788.

User – a Client or recipient of services provided by the Seller.

§2 General Provisions

  1. These Terms and Conditions set out the rules for using the Store and the rules and procedure for concluding distance sales contracts via the Store.

  2. The Terms and Conditions are continuously available on the Store’s website in a manner allowing them to be downloaded, stored, and reproduced at any time (including printing or saving on a durable medium).

  3. Making purchases in the Store requires access to a computer or mobile device with Internet access, a standard operating system, an Internet browser supporting JavaScript and necessary cookies, and access to e-mail. To complete a purchase, the Client must complete the ordering process and provide the data required to fulfill the order.

  4. If the Seller offers digital content or services requiring specific technical conditions, such requirements will be indicated in the product description in the Store.

  5. In the event of a price reduction, the Seller will provide information on the lowest price within the 30 days preceding the reduction, in accordance with applicable law.

  6. The specifics and characteristics of each Good are included in its product description in the Store.

  7. It is prohibited to transmit unlawful content via the Store’s forms.

§3 Purchasing in the Store

  1. The Client may purchase in the Store without registering an Account.

  2. The gross price of Goods, including VAT, is displayed on the Store’s website. Prices do not include delivery costs, which are specified in the ordering process.

  3. Information about Goods on the Store’s website, including descriptions, parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.

  4. After selecting Goods, the Client should follow the instructions displayed on the Store’s website. Discount codes may be applied during checkout.

  5. To place an order, the Client must provide data marked as mandatory. Until clicking the “Pay now” button, the Client may modify the order or data.

  6. An order is finalized by clicking the “Pay now” button on the order summary page, after adding Goods to the cart, providing data, and accepting the Terms and Conditions.

  7. After placing an order, the Seller will promptly confirm its receipt and acceptance by sending an e-mail confirmation. Upon receipt of this confirmation, a Sales Agreement is concluded.

  8. Depending on the type of Goods ordered, the contract may be:
    a) for physical goods – a sales agreement,
    b) for services – a service agreement,
    c) for digital content – an agreement to supply digital content,
    d) for digital services – an agreement to provide digital services.

  9. The Terms and Conditions are provided to the Client by e-mail and secured in the Store’s IT system.

  10. The Seller reserves the right to suspend order fulfillment in cases of justified doubts regarding the accuracy of Client data.

§4 Delivery and Payments

  1. Delivery of Goods is available within the territory of Poland.

  2. Available delivery methods are indicated during checkout, including:

    • DPD Pickup Point

    • InPost Parcel Locker

    • DPD Delivery

  3. Delivery of Goods requiring shipment is paid unless stated otherwise. Delivery costs are displayed during checkout. The Store may send multiple packages within one order at no extra cost to the Client.

  4. Delivery time is up to 10 business days unless otherwise stated in the product description or during checkout. For multiple Goods with different delivery times, the longest delivery time applies.

  5. For digital content or services, electronic delivery occurs immediately or within 2 business days unless otherwise stated (e.g. presale).

  6. Access to digital content and services may also be provided cyclically, according to the description.

  7. The Store accepts the following payment methods: traditional bank transfer and electronic payments.

  8. Electronic payments may be made via:

    • Apple Pay

    • Stripe

    • Przelewy24

  9. The Client must make payment within 5 business days of concluding the contract. After this period, the order may be canceled.

  10. The Client agrees to receive invoices in electronic form.

§5 Non-conformity of Goods; Complaints

  1. The Seller’s liability for Goods that are not in conformity with the contract is determined by applicable law, in particular the Polish Consumer Rights Act.

  2. The Seller informs Clients of their statutory rights in case of non-conformity. The Consumer may also use any warranty provided.

  3. Before submitting a complaint, the Client is asked to contact the Seller at hello@moretalks.shop or +48 790 890 788.

  4. Complaints and returns should be sent to: MoreTalks, ul. Trakt Królewski 182A, 05-083 Zalesie, Poland.

  5. Goods are considered in conformity with the contract if they match their description, type, quantity, quality, and functionality. For Goods with digital elements, compatibility, updates, and suitability are also required.

  6. If Goods are not in conformity, the Consumer may request repair or replacement.

  7. The Seller may replace instead of repair, or repair instead of replace, if the chosen method would be impossible or disproportionate.

  8. Repair or replacement must be carried out within a reasonable time and without undue inconvenience to the Consumer. Costs are borne by the Seller.

  9. The Consumer must make the Goods available for return. The Seller collects them at no cost.

  10. In certain cases, the Consumer may request a price reduction or withdraw from the contract.

  11. Refunds following a price reduction must be made within 14 days.

  12. In the event of withdrawal, the Consumer must return the Goods, and the Seller refunds the price within 14 days of receipt.

  13. The Consumer cannot withdraw from the contract if the non-conformity is minor.

  14. The Seller is liable for non-conformity revealed within 2 years of delivery.

  15. Non-conformity appearing within 2 years is presumed to have existed at delivery unless proven otherwise.

  16. The Seller must respond to complaints within 14 days.

  17. For digital content or services, the Seller is liable for conformity for the period agreed in the contract, not less than 2 years.

  18. If Goods are covered by a warranty, details are provided in the product description.

  19. Rights regarding non-conformity apply to Consumers and Entrepreneurs with consumer rights.

§6 Right of Withdrawal

  1. Consumers have the right to withdraw from the contract within 14 days of receiving Goods, or within 14 days of concluding the contract for digital content or services.

  2. To exercise this right, the Consumer must notify the Seller (MoreTalks, Co&Sisters Katarzyna Chilimoniuk, ul. Trakt Królewski 182A, 05-083 Zalesie, hello@moretalks.shop, +48 790 890 788).

  3. The deadline is met if the notification is sent before the 14-day period expires.

  4. Upon withdrawal, all payments, including standard delivery costs, will be refunded within 14 days. Additional delivery costs (e.g. express shipping) are excluded.

  5. Refunds will be made using the same payment method unless otherwise agreed.

  6. The Seller may withhold the refund until the Goods are received or proof of return is provided.

  7. Returns should be sent to: MoreTalks, Katarzyna Chilimoniuk, ul. Trakt Królewski 182A, 05-083 Zalesie.

  8. Goods must be returned within 14 days of withdrawal.

  9. The Consumer bears the direct cost of returning Goods.

  10. The Consumer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature and functioning of the Goods.

  11. Exceptions: Withdrawal rights do not apply to cases listed in Article 38 of the Polish Consumer Rights Act, including custom-made Goods, perishable Goods, sealed items opened after delivery, digital content already supplied with consent, etc.

  12. Withdrawal does not apply to entities other than Consumers or Entrepreneurs with consumer rights.

§7 Provision of Services by Electronic Means

  1. The Seller takes steps to ensure the proper functioning of the Store and commits to remedying any defects.

  2. Free electronic services provided by the Seller include:

    • creating an Account,

    • concluding contracts electronically,

    • subscribing to the newsletter.

  3. An Account is created via a registration form. A free electronic services agreement is then concluded.

  4. The Client may delete the Account at any time.

  5. Account data includes personal details and orders. Past order data may be retained for legal reasons.

  6. Newsletter subscription may be canceled anytime.

  7. Complaints regarding Store functioning must include the Client’s name, address, and description of the issue.

  8. Complaints will be handled within 14 days.

  9. Newsletter content is protected by copyright.

  10. Consumers may withdraw from digital services contracts within 14 days.

§8 Provisions for Entrepreneurs

  1. This section applies to Clients who are Entrepreneurs.

  2. Liability under statutory warranty is excluded.

  3. The Seller may terminate Account services immediately without liability.

  4. The Seller may withdraw from the contract within 14 days without liability.

  5. The Client must check deliveries promptly; the Seller is not liable for damage caused by carriers.

  6. The Seller may limit payment methods or require prepayment.

  7. The Seller’s liability is limited to the value of the Goods; loss of profits is excluded.

  8. Disputes will be resolved by the court competent for the Seller’s registered office.

  9. These provisions do not limit the rights of Entrepreneurs with consumer rights.

§9 Reviews

  1. The Seller verifies consumer reviews to ensure authenticity. Reviews are checked against actual purchases.

  2. Both positive and negative reviews are published. No incentives are given for reviews.

  3. Reviews reflect genuine purchase experiences.

  4. Reviews on third-party sites are subject to their verification rules.

§10 User Content

  1. User Content includes reviews, comments, or other information voluntarily added by Users.

  2. Users may not post illegal content, including:

    • unlawful material,

    • content infringing personal or copyright rights,

    • spam,

    • unfair competition activities,

    • irrelevant or harmful material.

  3. The Seller may moderate, block, or remove illegal content.

  4. Illegal content can be reported by e-mail (hello@moretalks.shop). Reports must include evidence and identification.

  5. The Seller will review such reports with due diligence.

  6. Users may appeal content decisions. Appeals will be reviewed within 14 days.

  7. In case of serious breaches, accounts may be suspended or removed.

  8. The Seller is not liable for User Content unless aware of illegality.

  9. The Seller will notify authorities if criminal activity is suspected.

§11 Personal Data Protection

  1. The Seller is the administrator of Clients’ personal data.

  2. Rules regarding processing, recipients, and rights are set out in the Store’s Privacy Policy.

§12 Final Provisions

  1. All rights to the Store and Goods, including intellectual property, belong to the Seller.

  2. The Seller may amend these Terms for valid reasons (e.g. legal changes). Clients will be informed by e-mail.

  3. The Seller may change prices or promotions without affecting prior contracts.

  4. Polish law applies to matters not covered by these Terms.

  5. Nothing in these Terms limits the statutory rights of Consumers or Entrepreneurs with consumer rights.

  6. Disputes should be resolved amicably where possible.
